Sales Terms and Conditions

Agreement

These Sales Terms and Conditions constitute the full sales terms and conditions offered by GIGDATA LLC. No warranties whether written or oral shall supersede this agreement. Receipt of goods and or services from GIGDATA LLC represents your acceptance to these terms and conditions.

Warranty

GIGDATA LLC warrants that any product or service purchased from GIGDATA LLC shall be free of any defects in the quality and or mechanical integrity for a period of time as defined on the sales invoice document. If you as our client find this to not be the case, you must notify a representative of GIGDATA LLC so that a remedy can be presented.

Remedies

GIGDATA LLC will remedy your claim with either a replacement or a credit at our discretion, never to exceed the sale amount of the item disputed, exclusive of any non-refundable taxes and shipping costs associated with the component in dispute.

Limitation of Liability

GIGDATA LLC will not refund or incur any costs for any loss of use or any potential damages caused by the item in dispute and any claims against GIGDATA LLC can never exceed the total sale amount of the item on the invoice associated with the claim.

GIGDATA LLC sells and provides used and refurbished data center equipment built to client specifications. Any device or component supplied by GIGDATA LLC will be tested and vetted to the best of our ability. As not all use cases can be thoroughly tested and vetted, GIGDATA LLC cannot guarantee compatibility of every device or component for any specific fit or purpose and will not be liable in any way to the extent a purchase from GIGDATA LLC does not solve a specific need.

Title and Encumbrances

GIGDATA LLC warrants that items delivered on any particular invoice will be free of any encumbrances and title to goods will be passed directly to purchasing party once payment for goods or services to GIGDATA LLC has been received in full. If payment is not tendered to GIGDATA LLC for goods and services, GIGDATA LLC may place a lien for those deliverables until the invoice and collection costs are paid in full. Invoices must be paid in a timely manner. Any invoices not paid on time may incur a 1.5% interest charge per month until the invoice is paid in full.

Severability

These Sales Terms and Conditions are severable in the event any clause is found to no longer comply with state law in which the business is conducted. GIGDATA LLC conducts business in the state of California.

Payments

GIGDATA LLC accepts payments from credit worthy clients by check which is due 30 days from the date goods or services are received. GIGDATA LLC also accepts credit cards through Stripe and PayPal payments. As all invoices are cash discounted, 2% of the Invoice amount will be added for any credit card or PayPal payment.

Shipping

GIGDATA LLC uses USPS, FedEx, UPS, and Sprinters shipping services for the delivery of goods and services. Items purchased will be packed with care and shipped to you based upon the method you select. Shipping costs will be added to invoices unless GIGDATA LLC will be shipping goods on your shipping account on file with the carrier. GIGDATA LLC may also deliver the goods to you and any fees to do so will be disclosed and approved prior to adding to any invoices.
