1. Copyright Infringement Reporting

In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), codified at 17 U.S.C. § 512, GIGDATA LLC will respond expeditiously to claims of copyright infringement committed using our website (gigdataserv.com) that are reported to our designated DMCA agent.

If you believe that content hosted on our site infringes your copyright, please submit a notification containing the information described below to our designated DMCA agent. Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

2. DMCA Takedown Notice Requirements

To be effective under 17 U.S.C. § 512(c)(3), a written notification of claimed infringement must include substantially the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works on the site are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Providing URLs in the body of the notice is the best way to help us locate content quickly.
  4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.

4. Counter-Notification Process

If you believe that material you posted on gigdataserv.com was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us pursuant to 17 U.S.C. § 512(g). A counter-notification must include substantially the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Central District of California if your address is outside the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

If a valid counter-notification is received, GIGDATA LLC will forward it to the original complaining party. The removed material may be restored within 10 to 14 business days after receipt of the counter-notification, unless our designated agent first receives notice from the complaining party that a court action has been filed seeking a restraining order against the user who posted the material.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, GIGDATA LLC has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, account holders who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

6. Good Faith and Misrepresentation Liability

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. If you are unsure whether the material you are reporting is in fact infringing, or whether the material that was removed or disabled is in fact non-infringing, you may wish to contact an attorney before filing a notification or counter-notification.
